States sue Bristol patent for Fraud

Twenty-nine state attorneys general file a complaint Tuesday against Bristol-Myers Squibb (BMY), according to the Bristol fraudulently obtained patents on its expensive cancer drug Taxol to keep cheaper generic medicines from the market.”This is another method of the pharmaceutical industry, drug prices exorbitantly high,” says Smith Meredyth Andrus, an assistant Attorney General in Maryland.

The 55-page complaint is the latest challenge for the pharmaceutical industry patent efforts made by the states, consumer groups and federal antitrust law. It is the second multistate lawsuit against Bristol. Late last year 29 countries challenged Bristol’s patent on anti-anxiety drug buspar.

Bristol would not comment directly on the allegations Tuesday.

“The actual events in question are several years old and were the subject of litigation for some time,” says Bristol spokesman Robert Laverty.

The various state challenges center on the efforts of the pharmaceutical industry to list new patents on existing drugs, moves can protect that these products from the competition after its first patents expire. While some new patents are legitimate, others are questionable, prosecutors allege, and unfair block generics.
