Bankruptcy Filings by 18% in February

Americans in increasing numbers in bankruptcy in February, as part of the loop combined weight of rising energy prices, a weakening of the real estate market and sky-high personal debts.

An average of 3,960 bankruptcy petitions were filed a day during the last month the national 18 per cent between January and to 28 per cent less than the previous year, after an automated access to the courts Electronic Records, a bankruptcy data and management of the company.

February was the most lively months for applications for review since Congress in bankruptcy during 2005. A bankruptcy experts said the increase was particularly worrying, because these changes, an application for insolvency proceedings more complicated and costly.

“The number of bankruptcies may be under-representing the real financial distress of consumers feel because of measures taken by Congress,” said Jack Williams, a scholar in residence at the American Bankruptcy Institute and professor at Georgia State University.

Latest figures show that the pain extends financial states like California and Florida, the example the boom in housing construction and bust, with whom, as along the east coast of Maryland, Virginia and Delaware, who were among the 10 countries with the largest percentage increase in applications in January and February. “You see a good size Uptick everywhere,” said Mike Bickford, President of Automated Access.

Insolvency experts caution, however, only data one or two months are misleading.

“The monthly rate of filing bankruptcy has a number of circumstances,” Robert M. Lawless, professor of law, science from the University of Illinois College of Law, wrote Tuesday on bankruptcy, read your blog, Creditslips.org. Some experts, for example, we often seem to increase bankruptcies in February as a debt of the holiday period expire. Nevertheless, the trend is clearly up, wrote M. Lawless. Different that countries such as Kentucky and Rhode Island in the top-10 list and the absolute number of applications has increased significantly.

Mr. Williams expects that the number of bankruptcies in Germany reached 1.2 million to 1.4 million this year, against 826732 in 2007, Mr. Lawless expects more than one million. (In 2004, the last year with a rate standardized data, 1597462 petitions were filed after the automated access).

The USA with the most marked increase in requests for bankruptcy in the first two months of 2008 was California, with a 33 per cent; Maryland, to 29 per cent, and Florida, up 26 % Displays data. Filings fell in 16 countries, including Colorado, Indiana, Ohio, South Dakota, Kansas, Wyoming.

Proponents of the bankruptcy law in 2005 that some consumers abuse the law, with Chapter 7, or liquidation, to illuminate debt credit card. The bill, backed by two Republicans and Democrats, increases spending for all and reduce protection measures for all, “said Williams.

Elizabeth Warren, professor at Harvard Law School and author of books on bankruptcy, said: “The credit industry has their best to push the cost of registration, but families are quite evil they are fighting their way through the bush and paper greater costs lawyer for help to make. ”

Ms. Warren said that the increase also reflects the recruitment amended bankruptcy. Many Americans now understand that the legal deposit is bankrupt, which does not have much appreciated a few years ago. During the last years of studies have shown that one of the seven families were managing the debt collection, promoting families are often not gone bankrupt, “she said.

“The word is leaking, that bankruptcy courts are Open For Business,” says Warren.

Record home foreclosures have contributed to the increase in bankruptcies, but on their own account so as not to last.

“Rising bankruptcy understates certainly stress, because bankruptcy is not a haven partitioning,” Mark Zandi, chief economist at Moody’s Economy.com, said. In the current state of the Bankruptcy Code, the courts did not alter the conditions of first mortgages. Legislation proposed in Congress trying to change that, but very few think it will happen.
